Kings Forest Service Station 24-hour operations
General
Approval for a modified development application to extend trading hours at the Kings Forest service station is almost complete. This change will benefit the growing community in Tweed Shire.
The proposal
The modified application seeks to allow the service station to operate 24 hours a day. It will remove current lighting curfews and noise limits. The food and drink area will also open an hour earlier at 5am for early customers. The plan includes updates to site and building design, with improvements for traffic management, parking, and circulation.
Assessment process
The assessment looked at key environmental factors. These included effects on homes, noise and light issues. It also assessed ecological concerns for nearby coastal wetlands and traffic management needs.
Sargeant Planning prepared a detailed response to the Tweed Shire Council’s objections. They claimed the proposal was not “substantially the same” and raised concerns about impacts on nearby residents. The response also addressed community feedback. Legal advice confirmed the proposed changes meet the “substantially the same” requirement under Section 4.55(2) of the Environmental Planning and Assessment Act 1979. This confirms that the changes won’t create greater environmental impacts than the approved development.
Imminent approval
The assessing Planning Officer has recommended approval for the application. The NSW government has previously deemed the service station as a major project.
